Malaysian aesthetic clinic ads open on the machine: Oligio at ECLAT De Clinic, the dS facelift at Derma Sculpture, hHF-NSC at Elegant Clinic Malaysia, mostly as 9:16 practitioner-to-camera video. Section 4A of the Medicines (Advertisement and Sale) Act 1956 (Act 290) bites only where an advertisement does two things at once: refer to a skill or service for treating, preventing or diagnosing a condition of the human body, and be capable of inducing, or carry an express or implied invitation to, a person to seek the advertiser's advice. Its proviso carves out two routes and only two, and the one a clinic uses covers a private hospital, private clinic, private radiological clinic or private medical laboratory operated by a registered medical practitioner holding a valid annual practising certificate under the Medical Act 1971, with Medicine Advertisements Board clearance of that exact creative on top. Clearance comes back as a KKLIU number that belongs on the ad where a reader can see it, beside its expiry date, and the board refused 360 of the 4,093 applications it received in 2024, against 299 refusals in 2023 (MOH Pharmaceutical Services Programme, 2024). You run a clinic, the next ad is due, and the feed you are competing in reads nothing like a skincare feed. Scroll it and you get a device name in the first three words, a doctor talking straight to camera in vertical video, a Chinese-language explainer on telling a true tear trough from a false one, a branch opening in Kota Kinabalu. Consultation offers barely appear, and across thirty of these creatives exactly one prints its approval reference on the artwork. The distance between what the law expects and what the category actually publishes is the problem worth settling before you brief. What the clinic feed actually leads with
Thirty clinic creatives, and the opening line is almost always a proper noun. ECLAT De Clinic leads on Oligio. Derma Sculpture leads on the dS facelift. Elegant Clinic Malaysia opens on hHF-NSC, Vincere Aesthetics Clinic on a ligament lift, Hairy Mary on the Thor-X laser, YoungBeauty.my on InstaGlow, Jacqueen de beaute aesthetic on a Japan vitamin IV drip. A patient searching for firmer skin will not recognise most of those words. Clinics run them anyway, because the machine is what the clinic paid for, and it hands a patient something specific to search before they message. The second habit puts a face on screen. Datuk Dr Inderjit opens with a plain hello and walks through the hardest ninety days after a hair transplant. RNS Beauty Aesthetics spends a whole vertical video teaching viewers to tell a true tear trough from a false one. Essenture TCM Clinic PJ demonstrates a technique. Three sections of Act 290, and which one you sit under
Clinic owners know approval exists. Fewer have read which of Act 290's three clauses reaches them. Section 3 is the hard stop. It reaches advertisements calculated to lead someone to use an article as a medicine, appliance or remedy for the twenty diseases in the Act's Schedule, for contraception, or for improving kidney, heart or sexual function. Its proviso exempts government, local authority and public hospital advertisements and anyone the Minister authorises, none of it realistically open to a private clinic. Section 4B is the prior-approval route for anything framed as a medicine, appliance or remedy. Retail a take-home product or device and that is your clause. Section 4A governs a clinic advertising itself, and both limbs have to be present at once. The advertisement must refer to a skill or service for treating, preventing or diagnosing a condition of the human body, and it must be capable of inducing, or carry an express or implied invitation to, a person to seek the advertiser's advice. Miss either limb and the section does not bite. The proviso carves out two routes and only two: publication with the Minister's approval by a professional medical or allied-profession body established or registered under written law, and Medicine Advertisements Board approval for a private hospital, clinic, radiological clinic or medical laboratory whose operator is a registered medical practitioner holding a valid annual practising certificate under the Medical Act 1971. Premises, practitioner and creative all have to line up. Penalties stay small. Section 5(1) reaches sections 3, 4, 4A and 4B: up to RM3,000 or a year on a first conviction, RM5,000 or two years after that, amounts untouched since 1980 in an Act with no amendments after 1990 (Act 290, Attorney General's Chambers reprint as at 1 May 2013). Sections 5(2) and 5(3), the presumption of participation and the technical-publication defence among them, cover only sections 3, 4 and 4B, while section 4A carries its own presumption at 5(2A) and a single defence at 5(4), proof that you had no idea you were taking part. A clinic that briefed its own ad cannot reach it.
Approval arrives with an expiry date
An approved advertisement receives a KKLIU reference, and that reference belongs on the ad where a reader can see it, beside the date it runs out. The Ministry of Health publishes the whole cleared set. As at 25 August 2026 the public register held 16,426 live entries, 5,601 of them, about 34%, under health services rather than products (MOH Pharmaceutical Services Programme, 2026). Two things follow for a clinic buying media. Your best-performing creative has a shelf life set by a date you do not control, and nobody sends a reminder when it passes. And the register is free to search by advertiser name, so you can check whether the ad you are about to imitate was ever cleared at all. The queue behind those entries is getting busier. Health-service applications rose to 1,463 in 2024 from 1,146 in 2023, inside 4,093 applications in total, of which 3,606 were approved, 89 were held not to need approval and 360 were refused, against 299 refusals the year before (MOH Pharmaceutical Services Programme, 2024). Just under nine submissions in a hundred came back rejected, so build a revision round into the launch schedule rather than treating sign-off as a formality. Screening has followed the audience. Of 28,401 pharmacy, health and medical advertisements the ministry screened in 2024, 19,689, roughly 69%, ran in new media, against 8,520 in print and 192 in broadcast, and 456 warning letters and 13,286 takedown or blocking notices followed (MOH Pharmaceutical Services Programme, 2024). Some clinic ads carry no treatment claim at all, and they are worth copying for what they cost to get live. True Clinic advertises for beauty therapists. FACE BAR posts a plain thank you. Neither refers to a skill or service, so neither meets the first limb of section 4A, and both keep a page warm between cleared campaigns. Dr. Chong Clinic's Kota Kinabalu branch opening reads like the same kind of post until you look at the artwork: it prints a Pico Laser and stem cell kit at RM199 beside KKLIU 0337 and an expiry date, which puts it back inside the treatment-ad regime with the paperwork to match. Can I run a clinic ad now and apply for approval afterwards?
No. Section 4A makes the publishing itself the offence, so there is no version of this where the creative runs first and the paperwork catches up. Clearance is granted per advertisement, against the exact version submitted, so a redesign, a reworded headline or a new price is a fresh advertisement needing its own reference. A rolling content calendar therefore means rolling submissions, and that includes the soft ones: a screening or assessment offer still refers to a service, so it needs clearance like any treatment ad. Two habits stop that throttling the account. Submit in batches at the brief stage, so the queue runs alongside production instead of after it. And keep an approval register of your own, one row per creative, with the reference, the approved medium, the language and the expiry date. An unapproved ad that has already spent is money nobody refunds.
What is a KKLIU number, and where can I check one?
It is the reference the Medicine Advertisements Board issues when it clears an advertisement, written as KKLIU followed by a serial and a year. The Ministry of Health publishes the cleared set as a public, searchable register, and every row names the advertiser, the approved medium (a website, the internet generally, video, all media except radio), the language of the approved version, the number itself and the date it expires (MOH Pharmaceutical Services Programme, 2026). That makes it useful in both directions: evidence of your own clearances, and a way to see which medium and language a competing clinic actually cleared. The medium field is the one clinics miss. Clearance granted for a website does not carry over to a video cut of the same message.
What can a Malaysian clinic never advertise, even with approval?
Section 3 of the Act reaches advertisements calculated to lead someone to use an article as a medicine, appliance or remedy for the twenty diseases named in its Schedule, for contraception, or for improving how the kidney, heart or sexual function works. The Schedule covers cancer, diabetes, heart and kidney disease, hypertension, tuberculosis, asthma, epilepsy, paralysis, leprosy, deafness, hernia, diseases of the eye, drug addiction, mental disorder and infertility, along with several sexual and venereal conditions the Act names in its own 1956 language. A proviso covers government, local authority and public hospital advertisements and anyone the Minister authorises, and a separate defence covers publication confined to medical professionals and trainees. Neither is realistically open to a private clinic. Wording around the Schedule does not help either, because the test is what the advertisement is calculated to lead a reader to do.
Does Act 290 reach a boosted Instagram post, or only print and broadcast?
It reaches them, through general words rather than a named list. The Act was drafted in 1956, and the words internet, online, website, social media and electronic appear nowhere in it. Its definition of an advertisement is deliberately wide: printed matter of almost any kind, plus any announcement made out loud or by any means that produces or transmits light or sound. A video playing on a phone produces light and sound, so it is caught. Boosting an organic post changes nothing in that analysis either, because the question is whether the advertisement was published, and a boosted post is published to an audience you paid to reach. The ministry's own screening workload bears that out in practice, with most of what it checked in 2024 carried in new media (MOH Pharmaceutical Services Programme, 2024).
Can I run before-and-after photos in a Malaysian clinic ad?
Two gates, and the platform one usually comes first. Meta's health and wellness standard prohibits weight-loss ads showing side-by-side before-and-after comparisons or a transformation, bars content implying negative self-perception or an ideal body type, requires realistic timeframes for results, and requires 18-plus targeting for weight-loss and cosmetic-procedure ads (Meta Advertising Standards, 2026). A classic split image can be rejected there even with your Malaysian paperwork in order. The second gate is Act 290, where a before-and-after is a claim: it has to be substantiable, representative of a typical result, and carried on a creative the board has cleared. Photographs of the treatment, the practitioner and an honest timeline clear both gates with less friction, which is one reason the practitioner explainer runs so widely in this category.
Do I need separate approval for the Malay and Chinese versions of the same ad?
Plan on it. Clearance attaches to the advertisement as it was submitted, so a translated cut is safest treated as fresh creative rather than a variant of something already cleared, and the board is the place to confirm your specific case before you brief. So does anything reaching one of the twenty Schedule diseases, where no approval route is realistically open to a private clinic. A comparative claim naming another operator's package stacks a platform problem on top of the statutory one. Refusals are common enough to plan around: the board turned down 360 submissions in 2024, up from 299 in 2023 (MOH Pharmaceutical Services Programme, 2024). The construction that gets through describes the treatment, says who it suits, invites a consultation, and carries the approval reference and a variability note on the creative itself.
How do I find more Malaysian clinic ad examples?
Two free sources do most of the work together. The Meta Ad Library shows what a page is running right now, searchable by clinic name, and the Ministry of Health's register of approved advertisements shows which of a clinic's ads carry a live KKLIU clearance and when it lapses. Reading them side by side tells you both what a competitor is publishing and what it cleared. The thirty examples on this page are representative angles from real Malaysian advertisers, chosen to show format and framing, and not a live feed of ads running at this moment.
